ICATT Air Ambulance Services
These Terms and Conditions govern the provision of medical evacuation and patient transportation services by ICATT Air Ambulance Services (“ICATT”), including charter aircraft, commercial air ambulance, and commercial airline stretcher arrangements.
By confirming a booking or accepting ICATT’s service quotation, the client agrees to these Terms and Conditions, subject to applicable law. Payment terms, cancellation charges, refunds, and overstay charges are governed separately by ICATT’s Payment and Cancellation Policy.
ICATT will provide a quotation specifying the applicable service charges and the scope of services included. Unless otherwise stated in writing, the quoted amount covers aircraft flying charges, the medical escort team, and associated logistics costs. Any exclusions, additional charges, applicable taxes, or variable costs will be communicated where applicable.
The final decision to proceed with a patient transfer rests with ICATT’s medical escort team in consultation with the pilot, taking into account the patient’s clinical condition, medical requirements, and flight safety. No client, patient attendant, or third party may override a decision made on clinical or aviation safety grounds.
ICATT and the pilot reserve the right to refuse boarding to any attendant or item of baggage, or to require its removal, where necessary for flight safety, aircraft loading restrictions, or compliance with applicable aviation requirements.
Additional therapeutic oxygen, wheelchairs, and other requested equipment may be arranged subject to availability, aircraft compatibility, and operational requirements.
If the patient’s condition at boarding differs materially from the information originally provided, ICATT may postpone or decline transportation where the medical team or pilot determines that the transfer may compromise patient safety, flight safety, or aircraft operations. Any such decision will be handled in accordance with applicable medical and aviation requirements.
ICATT shall not be responsible for delays or diversions arising from circumstances beyond its reasonable control, including air traffic control (ATC) restrictions, airport or government authority decisions, adverse weather, security concerns, or other operational limitations, subject to applicable law and the terms of the booking.
All air ambulance services are subject to aircraft availability, airworthiness, crew availability, regulatory clearances, and prevailing weather and operational conditions. A booking confirmation does not override any medical, technical, regulatory, or flight safety requirement.
If a flight must be diverted, rerouted, delayed, or operated through an alternative sector due to weather, technical issues, parking limitations, refuelling requirements, airport restrictions, or the unavailability of night parking facilities, additional costs may arise.
Where applicable, additional flying hours, aircraft or helicopter waiting time, crew accommodation, lodging, and related operational expenses will be handled in accordance with the agreed quotation and applicable Payment and Cancellation Policy. Any additional charges will be communicated to the client as reasonably practicable.
ICATT maintains or arranges applicable insurance coverage in accordance with relevant requirements and the arrangements applicable to the specific aircraft and service. The scope, limits, exclusions, and conditions of insurance are governed by the relevant policy documents.
Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
Applicable taxes and statutory charges in force on the date of service will be payable by the client, patient, or other responsible contracting party, as specified in the quotation or booking agreement.
All quotations are estimates based on the proposed route, estimated distance, aircraft performance, and anticipated operational requirements. Estimates may not account for unforeseen weather delays, refuelling, VIP or other restricted flight movements, unserviceable runways, or other operational changes unless expressly stated.
Where specified in the quotation, final charges may be calculated using actual Block Flight Time, measured from engine start to engine shutdown, together with applicable aircraft or helicopter ground waiting time and other agreed charges.
Depending on the service and quotation, charges may include aircraft rental, crew costs, maintenance, insurance, fuel, in-flight catering, navigation charges, landing fees, parking charges, and associated logistics.
ICATT may be unable to operate or complete a charter because of circumstances beyond its reasonable control, including severe weather, poor visibility, unavailable ATC or other required clearances, government or defence authority restrictions, technical issues, or other unforeseen operational circumstances.
If a flight is cancelled and cannot be rescheduled, refunds will be processed in accordance with ICATT’s Payment and Cancellation Policy and applicable law. Any advance payments made to third parties, including landing charges at uncontrolled airstrips or helipads and aircraft fuel-positioning charges, may be non-refundable where the relevant amounts have already been incurred and cannot be recovered, subject to applicable law and the agreed booking terms.
Where a flight is diverted or cancelled on the direction of the pilot or relevant authorities, ICATT will communicate the operational implications and any applicable additional costs as reasonably practicable. Responsibility for costs and any resulting claims will be determined in accordance with the agreed terms and applicable law.
Destination weather and operational conditions will be assessed before departure. However, conditions may deteriorate unexpectedly during the flight or at the destination, preventing a safe landing.
In such circumstances, the aircraft may return to its point of origin or divert to an alternative airport. ICATT cannot guarantee arrival at the originally planned destination when landing is prevented by weather, safety, or regulatory restrictions.
Aircraft may experience technical issues that affect flight operations. If a technical issue cannot be rectified within the required timeframe, the flight may be delayed, cancelled, or subject to alternative arrangements, depending on aircraft availability and operational feasibility.
ICATT will communicate material changes to the client and discuss available alternatives where reasonably practicable.
Unless otherwise confirmed in writing, the standard cabin baggage allowance is one cabin bag per person, not exceeding 7 kg. Baggage remains subject to aircraft-specific size, weight, and safety restrictions. Additional baggage may be refused or accepted only with prior approval.
These Terms and Conditions shall be governed by the laws of India. Subject to applicable law, the courts of Bengaluru, Karnataka, India, shall have exclusive jurisdiction over disputes arising from these Terms and Conditions.
